SAN FRANCISCO, Calif. (AP) - The arraignment for the tech consultant accused of killing Cash App founder Bob Lee has been delayed until next Monday after his attorney informed a San Francisco court Tuesday that prosecutors had not given her all the evidence.

Nima Mumeni, 38 was charged with the murder of Lee on April 4, with an enhancement for using a blade. Momeni was due to appear in court on May 2 without bail.

Prosecutors claim Momeni drove Lee into a remote area and then stabbed him in retaliation for a dispute involving the suspect's younger sister.

Paula Canny said Momeni will plead not guilty to the charge and deny it. She will ask that Momeni remain in the public eye during his trial.

My argument will be that Nima does not pose a danger to society, and Nima poses no flight risk. If those two criteria are met under the law, then he should be freed from custody," Canny said.

San Francisco District Attorney Brooke Jenkins stated that her office had shared all the evidence with the defence, except an autopsy report which can take a medical examiner as long as 60 days to produce. She said that prosecutors would continue to argue Momeni should remain in jail because he poses a flight threat and is a danger to the society.

"Someone who we believe has committed murder poses a grave threat to public safety. In this case, an individual stabbed Mr. Lee several times, even in the heart. Jenkins said, 'That is as dangerous as you can get.

Elon Musk, a tech leader who took to Twitter in mourning Lee's passing and blaming San Francisco's lax approach to crime, brought national attention to the killing.
